*✦​Sahaba aur IJTIHAADI MASAIL✦​*
📗 ✔Aage badhne se pahle ek Buniyaadi baat ko samjna bahot aham hai ke kisi bhi ikhtilaafi masail ya Ijtihaadi masail ka hal malum karne ke liye Itteba aur Pairawi is serial number se ki jayegi:
*1. Allah aur uske Rasool :*
(Yani Sabse pahle Quran Wa Sahih Hadees me us ikhtilaafi masle ka hal talash karenge)
*2. Sahaba:*
(Agar Quran Wa Hadees me wazeh taur par hal na milne par Sahaba ke aasaar, Aqwaal aur Fatwo ke mutabik hal talash karenge)
*3. Tabi'een/Tab-Tabi'een/Imam:*
(Agar Sahaba ke paas bhi agar koi hal nahi mil paaye to unke baad wale Tabi'in, Tab-Tabi 'in aur Ahle Sunnat wal Jamat ke Imam ke fatwon mai us masle ka hal talash karenge)
*4. Aajke Mufti/Aalim :*
(Agar masla bahot hi modern ho to maujuda daur ke Aalim aur Mufti Quran Wa Sunnat ki Roshmi me hal talash karenge)
🔹Agar kisi Sahabi ka amal Rasoolullah (Sallallahu A'laihi WaSallam) ki kisi Sahih HADEES se takraate huye dikhayi de to aise waqt me is masle me "Ahle ilm" ka kahena hai ke "Sahabi  ke us Amal ko Sahabi ka khudka IJTEHAAD (qayas) samajenge aur Sahabi ke us kaam par ham amal nahi karenge isliye ke ham Rasoolullah (Sallallahu A'laihi Wa Sallam) ke Ummati hone ke naate ham par har haal me RASOOL ki Pairawi karna FARZ hai.
🔹Gaur karne par pata chalta hai ke IJTEHAAD ke baab me hi hamko kabhi kabhi Sahabi ke Fiqhi masail me TAKRAAW nazar ayega lekin apko aisa kahi bhi nahi dekhega ke ISLAM ke kisi BUNIYAADI  AQAAEED (fundamental  beliefs) and MANHAJ ke masle me kisi bhi Sahabi ka Amal Nabi (Sallallahu A'laihi WaSallam) ki Sahih Hadees se kabhi takraataa huwa nazar nahi ayega.
🔹Kisi Sahabi ne kabhi aisa nahi kaha ke SHIRK jayez hai ya Biddat jayez hai ya Taqleed jayez ya Sud Khana jayez hai ya Zakaat dena farz nahi hai wagaira wagaira.
Imam Shaukani (Rahimahullah) ne likha hai ke Mumino ke dusre Khalifa Umar (Radhi Allahu) aur Abdullah bin Masood (Radhi Allahu) ke bich marte dam tak 100 Fiqhi aur Ijtehaadi masail me ikhtelaaf tha sirf 3 Maslo par dono raazi huye the.
Yaha na hi Umar (Radhi Allahu) ne Abdullah bin Masood (Radhi Allahu) ki Taqleed aur na hi Abdullah bin Masood (Radhi Allahu) ne Umar (Radhi Allahu) ke dar se us waqt ke Khalifa Umar (Radhi Allahu) ki Taqleed ki. Naa hi is wajah se unke bich dushmani thi. Wo ek dusre ki izzat kiya karte the.
🔹Kahene ka matlab ye hai ke *saare Sahaba ka CENTER POINT ITTEBA-e-ALLAH aur RASOOL tha* isliye unke paas Fiqhi masail me ikhtelaaf ho jaane ke bawjood bhi FIRQA BANDI NAHI HUYI jaisa baad ke zamano me FIQHI ikhtelaaf ke wajah se 4 bade FIRQE WAJOOD me aaye jinko ham HANAFI, MALIKI, SHAFI'EE, HAMBALI kahte hai.
🔹Fiqhi masail me Nabi (Sallallahu A'laihi WaSallam) ko chhodkar kisi bhi Musalman se galati hone imkaanaat (chances) hai chaahe wo Sahabi ho, Imam ho koi bhi ho kyunke Rasoolullah (Sallallahu A'laihi WaSallam) ne khud Kaha ke .....
🍃 *"Jab koi MUJTAHID (jisko Faqi ya Mufti Kaha jata hai) ijtehaad karta hai aur uska ijtehaad sahih nikal aataa hai to usko 2 nekiya milti hai agar uska ijtehaad galat nikal aata hai tab bhi usko 1 neki milegi"*.

🔺Is Hadees  ye baatein malum hoti hai:
*1. Agar MUJTAHID ka IJTEHAAD (FATWA) agar sahih nikal aataa hai to usko 2 nekiya milegi. Ek neki koshish kiye jaane ke badle aur dusri neki uska qayas (conclusion) sahih hone ke wajah se.*
*2. Agar MUJTAHID ka IJTEHAAD (FATWA) agar galat nikal aata hai to usko sirf uske koshish kiye jaane par 1 neki milegi.*
*3. Isliye, MUJTAHID ka har IJTEHAAD sahih hota hai aisa kahena bilkul galat hai, isme khata (galati) hone ki gunjaaish hoti hai.*
*4.Islye  kabhi agar kisi MUJTAHID se kisi mamle me galati ho jaye to uske us galati ko ham NAHI LENGE lekin us MUJTAHID ki izzat zarur karenge aur usko bura-bhala bhi nahi kahenge kynke usko koshish karne ke badle me 1 neki mil chuki hai.*
*5. Lekin ek yaad rahe ke agar awwam (public) kisi dusre Mujtahid (Mufti) se pahle wale MUJTAHID (Mufti) ke Fatwe ne ya Ijtehaad me galati hui iska pata chal jaye aur awwam usi galat fatwe pe amal kar rahi hogi to aisi Surat me Awwam koi neki nahi milegi ulta hat-dharmi ka gunah hoga. Awwam ko to sahih fawte par amal Karna hoga.*
*Aur Mujtahid ko bhi chahiye ke kisine uski galati ko Quran Wa Sunnat ke Roshni me zaahir kare to wo apne galati se Haq ki taraf ruju kare.*
