Shariyat Aur Fiqh ME Buniyadi FArk Kya Hai?

SHARIYAT aur FIQ'H me BUNIYAADI farq kya hai…❓

BismillahirRahmanNirRaheem

Kisi bhi masle ka hal talaash karne ke liye Islami Shairiyat me.

    1 Quran

    2 Hadees

    3 Ijma

    4 Fiqh

Yeh 4 chize maujud hai.
FIQ'H ki zarurat kab aur kaise ...❓
FIQ'H ki zarurat utni aur waise hi hai jaise bhook ke wajeh se agar jaan jaane ka khatara ho to aise halaat me ek musalman ko Suwwar ka haram gosht khana halal hai.

Yaani kisi bhi masle ka hal (solution) sabse pahle Quran wa Hadees me talaash kiya jayega agar waha nahi mila to fir hamko IJMA ya FIQ'H ki taraf aana hoga.
Yaani FIQ'H sabse akhari zariya (very last option) hai maslo ke hal ke liye. Alhamdulillah, Quran wa Sahih Hadees me taqriban har masle ka hal maujud hai. Sirf apne apne daur ke Jadid  maslo ke hal me IJMA aur FIQ'H ki zarurat hoti hai.
Lekin aaj logo ne FIQ'H ko Quran Wa Hadees ka replacement bana diya hai. Har masle ka hal ham sabse pahle FiQ'H me talaash karte hai. Dekhte hai fala Imam ne kya kaha? Kabhi yeh nahi dekhte ke Allah aur uske Rasool ne kya kaha? Ye ek bahot badi gumrahi hai. Iske wajah se Ummat me Taqleedi mijaaz paida huwa aur Ummat Taqleed me dub gayi.
✔Sahaba (R) bahot hi ehtiyaat se aur Allah se darte huye zarurat ke waqt fiq'hi masaail ka hal pesh karte the. Unke liye assal Shariyat Qur'an Wa Hadees hi thi. Isliye Sahaba me FIQ'HI ikhtelaaf hone ke bawjood FIRQABANDI nahi hui jaise aaj ham dekhte hai ke Fiq'h ke naam par ZAFARI, HANAFI, MALIKI, SHAFAI, HANBALI firqe wajood me aagaye.
 *SHARIYAT aur FIQ'H me BUNIYAADI farq is tarah hai :
1⃣  SHARIYAT, Qanoon ke us jamaa (collection) ka naam hai jo Asman se Allah ki taraf se NAZIL ki gayi aur Quran wa Hadees ki shakl me mahefuz (secure) hai.
Jabki FIQ'H us ILM ko kahte hai jiske zariye SHARIYAT ki BUNIYAAD par aise masaail ka hal (solution) talaash karne ki koshish ki jaati hai jinka SHARIYAT me wazeh taur par zikr nahi hai.
Iska matlab SHARIYAT ke jo wazeh Ehkaam hai unko samajne ke liye FIQ'H ki zarurat nahi. Quran wa Sahih Hadees kaafi hai.
2⃣ SHARIYAT har taur se mukammal hai (dekhiye Surah 05 Maydah : Ayat 03).
Jab ke FIQ'H kabhi bhi Mukammal nahi ho sakti kyunke har anewale naye zamaane me naye naye masail pesh aate rahenge, in naye masaail ka hal to purane FIQ'H me nahi hoga isliye Quran wa Hadees me gaur wa fikr kar ke naye daur ke naye Ulema un naye masaail ka hal taalash karenge.
Maslan, Blood donation, Kidney Donation, Aero plane me Namaz, in modern maslo ka hal apko Hanafi, Maliki, Shafi’I aur Hanbali Fiqh me kaha se milega ? Lekin Quran wa Hadees me aaj bhi in modern masaail ka hal maujud hai.
3⃣SHARIYAT ek tay-shuda QAYADA hai aur jisme koi tabdeeli nahi ki ja sakti jabke FIQ'H halaat ke mutabik tabdeel hota rahta hai.
4⃣Sharai Qanoon aam qism (general category) ke hote hai we buniyaadi USOOL muqarrar kar dete hai.
Jabke FIQ'H ke Qanoon KHAAS (specific) hote.
5⃣SHARIYAT ke har Qanoon me lachak (flexibility) hoti jo har zamane ke liye bilkul FIT ho jaate hai isliye Islam ko ek “KAMIL aur SHAMIL” Deen kaha jata hai.
Jabke FIQ'H me flexibility nahi hoti kyune FIQ'H kisi ek KHAAS masle ko lekar bahes karti hai.
6 FIQ'H ki Buniyaad Shariyat hai (yaani Quran wa sahih Hadees hai) lekin SHARIYAT ki buniyaad FIQH nahi hai.

Aye Allah, hamko ilm ke mutabik amal karne wala bana de. Hamare andar ikhlaas paida kar. Riya se bacha. Hamare in koshisho ko qubul farma aur logo ke liye Hidayat ka zariya bana de. Jo bhi galatiya hui hai usko maaf kar de.
